Terms of sale
These General Terms and Conditions of Sale (the “GTCS”) apply to the sale, to consumers (the “Customer”), of the products (the “Products”) presented on the ANOMALIA PARIS online boutique (the “Online Boutique”), accessible via the Seller’s website (the “Site”), excluding special orders and custom-made / personalised products.
The Seller of the Products is:
registered office: 66 avenue des Champs Élysées, 75008 Paris, France,
registered with the Paris Trade and Companies Register (RCS) under number 894 960 137,
email: client@anomaliaparis.com
Given the prestigious nature of the Products, their sale is carried out within the framework of a selective distribution network. Consequently, Products purchased via the Online Boutique may under no circumstances be distributed, resold or transferred for commercial or professional purposes.
The applicable GTCS are those in force on the date of the order. The Seller may amend the GTCS at any time; however, such amendments shall not apply to orders already confirmed.
- “Customer”: a consumer, being a natural person acting for non-professional purposes.
- “Products”: fragrances and/or related items offered on the Site.
- “Order”: the purchase of Products made via the Online Boutique.
- “Business Day”: Monday to Friday, excluding public holidays in France.
The Seller endeavours to ensure that Product descriptions are as accurate as possible. Photographs, visuals and texts are provided for illustrative purposes only and have no contractual value; slight variations may occur (screen rendering, packaging).
Offers are valid subject to available stock. If a Product becomes unavailable after an Order has been placed, the Seller shall inform the Customer as soon as possible by email. The Customer may:
- (i) be refunded for the unavailable Product, and/or
- (ii) accept an adjustment to the Order, and/or
- (iii) cancel the Order.
In the event of cancellation, the refund shall be made no later than 14 days from the agreement on the cancellation.
For certain Orders, the Customer may select up to two (2) complimentary samples (2 ml format). If a selected sample is unavailable, the Seller may replace it with another sample of comparable spirit/value, without giving rise to any claim.
All prices are stated in euros, inclusive of VAT, excluding delivery charges. Delivery charges are displayed before final confirmation of the Order. Depending on the delivery location, customs duties, local taxes and/or import fees may apply in accordance with local regulations and shall remain the Customer’s sole responsibility.
Payment in full is due at the time of the Order, by:
- bank card (Carte Bleue, Visa, MasterCard, American Express),
- PayPal,
- (subject to the payment methods available at the time of payment).
Orders are dispatched only after payment has been verified and the corresponding authorisation has been received.
The Seller reserves the right to refuse or cancel an Order for legitimate reasons, in particular in the event of suspected fraud, payment incident, inconsistent information, unverifiable address, or abnormal Order.
The Seller retains ownership of the Products until full payment of the price has been received (principal and any applicable fees).
The Customer declares that they are of legal age and have the legal capacity to enter into a contract. The Products are intended for personal, non-professional use.
The ordering process is as follows:
- The Customer selects one or more Product(s) offered on the Site;
- By clicking “Add to Cart”, the Customer reviews the selected items;
- The Customer may choose up to 2 complimentary samples (2 ml format), where applicable;
- The Customer confirms the cart via “Proceed to Checkout”;
- The Customer enters their contact details, as well as billing and delivery information;
- Payment is made by bank card or PayPal;
- An order confirmation is then sent by email.
The Seller may refuse Orders deemed abnormal, in particular purchases of more than six (6) Products of the same reference (same SKU), or any Order suggesting an intent to resell.
The sale is concluded upon receipt of the confirmation email. The Seller’s electronic records shall constitute proof of the transactions, unless proven otherwise.
Orders are generally prepared within 2 to 3 Business Days (excluding exceptional periods). Shipment takes place only after payment has been verified.
Delivery times are indicative only (customs, inspections, weather conditions, periods of high activity, force majeure may affect timeframes):
- France: generally 2 to 5 Business Days from dispatch;
- International: up to 3 weeks depending on destination.
In any event, where no specific timeframe has been agreed, the Seller shall deliver no later than within 30 days, in accordance with applicable law.
The Customer is responsible for the accuracy of the information provided. In the event of an address error resulting in parcel return or impossibility of delivery, redelivery costs may be charged to the Customer or deducted from any refund.
As fragrances are alcohol-based products, transport restrictions may apply in certain countries. If delivery becomes impossible for legal reasons or due to carrier restrictions, the Order may be cancelled and refunded.
The risk of loss or damage passes to the Customer when the Customer (or a third party designated by them, other than the carrier proposed by the Seller) takes physical possession of the Products.
Upon delivery, the Customer is invited to inspect the parcel and the Products. In the event of apparent damage, the Customer must make precise reservations with the carrier and immediately inform the Seller at client@anomaliaparis.com in order to facilitate the handling of the claim (without prejudice to the Customer’s legal rights).
In accordance with French consumer law, the Customer has a right of withdrawal for 14 days from the date of receipt, without having to state any reason.
To exercise this right, the Customer must send an unambiguous written statement (email to client@anomaliaparis.com) or use the standard form set out in Appendix 1.
Unless otherwise required by law, Products may only be returned if they are intact, unused and perfectly sealed in their original packaging (cellophane and/or tamper-evident seals). For reasons of health protection and hygiene, Products unsealed by the Customer after delivery, and which cannot be returned in conditions allowing their resale, may be excluded from the right of withdrawal.
The Customer shall be liable for any depreciation in value of the Product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Products.
In the context of exercising the right of withdrawal or any return accepted by the Seller under its commercial policy, and in order to ensure compliant transport of alcohol-based Products, any return must imperatively be organised by ANOMALIA PARIS or carried out in accordance with its prior instructions. To initiate a return, the Customer must:
- Contact customer service: client@anomaliaparis.com (before any shipment),
- Wait for the instructions and use the label/authorised carrier provided,
- Carefully pack the parcel in accordance with the instructions.
Any return shipped without prior authorisation, without the provided label, or via an unauthorised carrier may be refused or remain at the Customer’s expense.
Return address (unless otherwise instructed by email):
ANOMALIA PARIS – Returns
18 chemin de Camperousse, 06130 Grasse, France
In the event of a valid withdrawal or a return accepted by the Seller in accordance with these GTCS, the Seller shall refund the sums paid for the returned Products, including, where applicable, the initial standard delivery costs, within fourteen (14) days from notification of the withdrawal. The Seller may defer the refund until the Products have been recovered or until the Customer provides proof of shipment. The refund shall be made using the same method of payment as that used for the Order, unless expressly agreed otherwise. The fixed return fee of twenty-five (25) euros including VAT, corresponding to the direct costs of the return organised in accordance with these GTCS, shall be deducted from the amount refunded to the Customer. By exception, no return fee shall apply where the return is made under the legal guarantee of conformity, for a Product damaged upon delivery, for an error attributable to the Seller, or in any other situation where the law requires the Seller to bear such costs.
Any returned Product received in a condition not compliant with these GTCS and the applicable return conditions — notably used, opened, unsealed, damaged, altered, incomplete or unfit for resale — may be refused and shall not give rise to any refund. If the Customer wishes to recover such Product, it may be re-shipped to them, upon request and at their expense. For re-shipments within Europe, the flat re-shipping fee is EUR 20, payable before the shipment is arranged.
Any gift included in the Order must also be returned in impeccable condition — unused, unopened, undamaged, with its seals/packaging where applicable. If these standards are not met, the Seller may: (i) refuse the return, or (ii) deduct from the refund the gift’s retail value including VAT.
The Seller is liable for defects in conformity in accordance with the French Consumer Code (Articles L.217-3 et seq.). The Customer has a period of two (2) years from delivery to request implementation of the legal guarantee of conformity. In the event of a lack of conformity, the Customer is entitled to have the goods brought into conformity by repair or replacement, or failing that, to a price reduction or termination of the contract, under the conditions provided by law.
The Customer may also rely on the warranty against hidden defects within the meaning of Article 1641 of the French Civil Code.
Within the limits permitted by law and without prejudice to the consumer’s mandatory rights, the Seller shall not be held liable for:
- damage resulting from improper use of the Products,
- use not in accordance with the usage precautions,
- temporary unavailability of the Site due to maintenance, updates or events beyond the Seller’s control.
Neither party shall be held liable for any failure to perform its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code (an event beyond control, unforeseeable and irresistible), including in particular strikes, transport disruptions, disasters, fires, pandemics, administrative decisions, etc.
The personal data collected are processed for the purpose of managing the customer relationship, Orders, delivery, after-sales service and, where applicable, marketing communications where the Customer has consented. The Customer may exercise their rights (access, rectification, objection, erasure, restriction, portability) by contacting: client@anomaliaparis.com. Further information is set out in the Privacy Policy available on the Site.
The Site and all of its elements (trademarks, logos, visuals, texts, photographs, design, etc.) are protected and remain the exclusive property of the Seller and/or its licensors. Any unauthorised reproduction or use is prohibited.
Any complaint must first be addressed to customer service: client@anomaliaparis.com, indicating full contact details and the Order number.
These GTCS are governed by French law. In the absence of an amicable resolution, jurisdiction shall be determined in accordance with the mandatory rules applicable to consumers.
