Terms of sale

These General Terms and Conditions of Sale (the “Terms of Sale”) apply to sales to consumers (the “Customer”) of the products (the “Products”) presented on the ANOMALIA PARIS online boutique (the “Online Boutique”), accessible through the Seller’s website (the “Website”), excluding special orders and bespoke or customised products.

The Seller of the Products is:

In view of the prestigious nature of the Products, they are sold through a selective distribution network. Accordingly, Products purchased through the Online Boutique may not, under any circumstances, be distributed, resold or transferred for commercial or professional purposes.

The Terms of Sale applicable to an order are those in force on the date of that order. The Seller may amend these Terms of Sale at any time; changes shall not apply to orders already confirmed.

• “Customer”: a consumer who is a natural person acting for non-professional purposes.
• “Products”: fragrances and/or related items offered on the Website.
• “Order”: the purchase of Products through the Online Boutique.
• “Business day”: Monday to Friday, excluding French public holidays.

The Seller endeavours to ensure that Product descriptions are as accurate as possible. Photographs, visuals and descriptions are provided for illustrative purposes and are not contractually binding; minor variations (screen display, packaging) may occur.

Offers are subject to stock availability. If a Product becomes unavailable after an Order has been placed, the Seller shall notify the Customer as soon as reasonably possible by email. The Customer may:

• (i) receive a refund for the unavailable Product, and/or
• (ii) agree to an adjustment to the Order, and/or
• (iii) cancel the Order.

In the event of cancellation, the refund shall be made no later than 14 days after agreement on the cancellation.

For certain Orders, the Customer may select up to two (2) complimentary samples (2 ml format). If a selected sample is unavailable, the Seller may replace it with another sample of comparable character/value, without this giving rise to a claim.

For any Order whose total Product value is equal to or greater than EUR 250 including VAT, excluding delivery charges and after any applicable discounts, the Customer may receive a complimentary 5 ml fragrance miniature, subject to availability. If the selected or advertised miniature is unavailable, the Seller may replace it with another available 5 ml miniature, without this giving rise to a claim. This miniature is a promotional gift with purchase and must, if the Order is withdrawn from or returned, be returned in accordance with Article 5.6 of these Terms of Sale.

All prices are expressed in euros, inclusive of VAT and exclusive of delivery charges. Delivery charges are shown before final confirmation of the Order. Depending on the delivery destination, customs duties, local taxes and/or import charges may apply under local regulations and shall be borne exclusively by the Customer.

Full payment is due when the Order is placed, using:

• a bank card (Carte Bleue, Visa, MasterCard, American Express),
• PayPal,
• (subject to the payment methods available at checkout).

Orders are shipped only after payment has been verified and the corresponding authorisation received.

The Seller reserves the right to refuse or cancel an Order for legitimate reasons, particularly in cases of suspected fraud, payment incidents, inconsistent information, an unverifiable address or an unusual Order.

The Seller retains ownership of the Products until their price (including any applicable additional charges) has been paid in full.

ANOMALIA PARIS gift cards are prepaid instruments that may be used to purchase products exclusively from the official online boutique at anomaliaparis.com, up to their available balance and within their validity period. They are available in two formats: the E-Gift Card, delivered by email, and the physical Gift Card, presented in a gift box together with six 2 ml fragrance samples carefully selected by ANOMALIA PARIS. The contents of this surprise selection are determined exclusively by the Maison; neither the purchaser nor the recipient may choose the fragrances. The code associated with the physical gift card is also sent by email.

Each gift card carries a unique code that may be used for one or more purchases exclusively at anomaliaparis.com, until its balance has been fully used or the card has expired. If an order exceeds the remaining balance, the difference may be paid using another payment method accepted on the Website. Once the balance reaches zero, the code can no longer be used to pay for further purchases unless funds are subsequently credited back to the card.

Gift cards are not issued in the name of a particular person. Anyone who possesses the unique code may use the corresponding balance, regardless of whether the email address used for a purchase matches that of the original recipient. Purchasers and recipients are advised to keep their code confidential. Amounts spent by a third party to whom the code has been voluntarily disclosed are deducted from the same balance and cannot be spent again. ANOMALIA PARIS shall not be liable for the consequences of voluntary disclosure of the code by the purchaser or recipient, except where ANOMALIA PARIS is at fault and without prejudice to the consumer’s statutory rights.

Gift cards do not permit cash withdrawals. Neither their face value nor any unused balance may be exchanged for cash, converted into a bank transfer, or otherwise paid out to the recipient. The recipient may not demand a cash refund of a gift card or its remaining balance. This provision does not affect mandatory statutory rights, including the right of withdrawal where applicable or any refund required by law.

Gift cards are valid for six (6) months from their date of issue. The precise expiry date is communicated with the code. Scheduling the email for a later date does not postpone the start of the validity period.

In the event of loss, theft, accidental disclosure of the code, or suspected unauthorised use, the purchaser or recipient is asked to contact ANOMALIA PARIS promptly at client@anomaliaparis.com. Following verification, ANOMALIA PARIS may deactivate the code to prevent any further use of the remaining balance. Reporting a loss or theft does not automatically entitle the holder to reimbursement of amounts already spent. Any complaint will be assessed in light of the circumstances, the parties’ respective obligations and applicable law.

Distance purchases of gift cards remain subject to mandatory consumer law provisions on the right of withdrawal, where applicable. Requests for refunds based on statutory rights will be handled in accordance with applicable law and the refund terms of these Conditions of Sale. The prohibition on exchanging gift card balances for cash does not prevent a refund required by law. If a product purchased using a gift card is returned, the portion of its price paid with the gift card may be credited back to a gift card, subject to applicable statutory requirements.

The Customer declares that they are of legal age and have the legal capacity to enter into a contract. Products are intended for personal, non-professional use.

The ordering process is as follows:

1. The Customer selects one or more Products offered on the Website;
2. By clicking “Add to bag”, the Customer reviews the items;
3. Where applicable, the Customer may choose up to two complimentary samples (2 ml format);
4. Where the total value of the Products reaches at least EUR 250 including VAT, excluding delivery charges and after any discounts, a complimentary 5 ml fragrance miniature may be added to the Order, subject to availability;
5. The Customer confirms the basket by clicking “Proceed to checkout”;
6. The Customer enters their contact details, billing information and delivery details;
7. Payment is made by bank card or PayPal;
8. An Order confirmation is sent by email.

The Seller may refuse Orders considered unusual, including purchases of more than six (6) Products of the same reference (same SKU) or any Order suggesting an intention to resell.

The sale is concluded upon receipt of the confirmation email. The Seller’s computer records constitute evidence of transactions, subject to proof to the contrary.

Orders are generally prepared within 2 to 3 business days (except during exceptional periods). Shipment takes place only after payment has been verified.

Delivery times are estimates (customs, inspections, weather conditions, busy periods and force majeure may affect them):

• France: generally 2 to 5 business days from dispatch;
• International: up to 3 weeks depending on the destination.

In all cases, if no specific delivery date has been agreed, the Seller shall deliver no later than 30 days, in accordance with applicable law.

The Customer is responsible for the accuracy of the information provided. If an incorrect address causes a parcel to be returned or prevents delivery, reshipping costs may be charged to the Customer or deducted from a refund.

As fragrances are alcohol-based products, shipping restrictions may apply in certain countries. If delivery becomes impossible for legal reasons or due to carrier restrictions, the Order may be cancelled and refunded.

The risk of loss or damage passes to the Customer when the Customer (or a third party designated by the Customer, other than the carrier proposed by the Seller) takes physical possession of the Products.

Upon delivery, the Customer is invited to inspect the parcel and Products. In the event of visible damage, the Customer should make specific reservations with the carrier and notify the Seller immediately at client@anomaliaparis.com to facilitate handling of the complaint (without prejudice to the Customer’s statutory rights).

Under French consumer law, the Customer has a right of withdrawal lasting 14 days from the date of receipt, without having to give a reason.

To exercise this right, the Customer must send an unequivocal written statement (by email to client@anomaliaparis.com) or use the model withdrawal form in Appendix 1.

Except where the law provides otherwise, Products may only be returned if they are intact, unused and perfectly sealed in their original packaging (cellophane and/or tamper-evident seals). For health protection and hygiene reasons, Products unsealed by the Customer after delivery that cannot be returned in a condition suitable for resale may be excluded from the right of withdrawal.

The Customer is responsible for any loss in value of a Product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.

When exercising the right of withdrawal or making any return accepted by the Seller under its commercial return policy, and to ensure compliant transport of alcohol-based Products, all returns must be arranged by ANOMALIA PARIS or carried out in accordance with its prior instructions. To initiate a return, the Customer must:

1. Contact customer service at client@anomaliaparis.com (before sending anything),
2. Await instructions and use the return label/authorised carrier provided,
3. Pack the parcel carefully in accordance with the instructions.

Any return sent without prior authorisation, without the label provided or through an unauthorised carrier may be refused or remain at the Customer’s expense.

In the event of valid withdrawal or a return accepted by the Seller under these Terms of Sale, the Seller shall refund the amounts paid for the returned Products, including any original standard delivery charges where applicable, within fourteen (14) days of being notified of the withdrawal. The Seller may defer the refund until the Products have been recovered or the Customer has provided proof of dispatch. Refunds shall be made using the same payment method as the original Order, unless expressly agreed otherwise. A fixed return charge of twenty-five (25) euros including VAT, corresponding to the direct costs of the return arranged in accordance with these Terms of Sale, shall be deducted from the amount refunded to the Customer. By way of exception, no fixed return charge shall apply where a return is made under the statutory guarantee of conformity, due to a Product damaged on delivery, an error attributable to the Seller, or any other situation where the law requires the Seller to cover the costs.

A returned Product received in a condition that does not comply with these Terms of Sale and the applicable return requirements — particularly if used, opened, unsealed, damaged, altered, incomplete or unsuitable for resale — may be refused and will not qualify for a refund. If the Customer wishes to recover such a Product, it may be reshipped upon request at the Customer’s expense. For reshipments within Europe, the fixed reshipping charge is 20 EUR, payable before reshipment is arranged.

Any promotional gift included with an Order, including a complimentary 5 ml fragrance miniature supplied with an Order amounting to at least EUR 250 including VAT, is inseparably linked to the purchase of the corresponding Product(s). If the Customer withdraws from or returns the Order, the gift must also be returned in the same condition as the main Product: intact, unused, unopened, undamaged, perfectly sealed and in its original packaging where applicable. If the gift is not returned or does not meet these conditions, the Seller may: (i) refuse the return in accordance with these Terms of Sale, or (ii) deduct the gift’s VAT-inclusive retail value from the refund.

The Seller is liable for lack of conformity in accordance with the French Consumer Code (Articles L.217-3 et seq.). The Customer has two (2) years from delivery to claim under the statutory guarantee of conformity. In the event of a lack of conformity, the Customer is entitled to have the goods brought into conformity by repair or replacement, or, failing that, to a price reduction or termination of the contract, under the conditions provided by law.

The Customer may also rely on the warranty against hidden defects under Article 1641 of the French Civil Code.

To the extent permitted by law and without prejudice to consumers’ mandatory statutory rights, the Seller shall not be liable for:

• damage resulting from improper use of the Products,
• use contrary to the precautions for use,
• temporary unavailability of the Website due to maintenance, updates or events outside the Seller’s control.

Neither party shall be liable for a failure to perform its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code (an event beyond the party’s control that is unforeseeable and irresistible), including strikes, transport disruptions, disasters, fires, pandemics, administrative decisions, etc.

Personal data collected are processed to manage customer relationships, Orders, deliveries, after-sales service and, where the Customer has consented, marketing. The Customer may exercise their rights (access, rectification, objection, erasure, restriction, portability) by contacting client@anomaliaparis.com. Further information is provided in the Privacy Policy available on the Website.

The Website and all its elements (trademarks, logos, visuals, texts, photographs, designs, etc.) are protected and remain the exclusive property of the Seller and/or its licensors. Any unauthorised reproduction or exploitation is prohibited.

All complaints must first be addressed to customer service at client@anomaliaparis.com, including full contact details and the Order number.

Under Articles L.612-1 et seq. of the French Consumer Code, consumer Customers may use a consumer mediator free of charge to seek an amicable resolution of a dispute with the Seller, after first submitting a written complaint to customer service without obtaining a satisfactory solution.

Consumer mediation is free of charge.

These Terms of Sale are governed by French law. Failing an amicable resolution, jurisdiction shall be determined in accordance with the mandatory rules applicable to consumers.
